THAPA KESHAR v. KONE ENGINEERING & CONSTRUCTION CO LTD AND OTHERS

    Citation
THAPA KESHAR v. KONE ENGINEERING & CONSTRUCTION CO LTD AND OTHERS
    Court
    Court of First Instance
    Case number
    HCPI416/2014

The court held that Order 18 r12 does not require treating doctors' medical reports to exhaustively list every pleaded particular or symptom; it requires substantiation of the underlying disease/injury. Where the underlying injury (here a fracture of the 5th metatarsal) is adequately substantiated by medical reports, the court will not order a stay for absence of reports listing every 'present problem'. Physiotherapist notes do not suffice for a separate medical diagnosis.
