Given the extensive but unsuccessful tracing efforts for Ho Kam Por, the relatively small size of the residuary estate, the majority consent of surviving beneficiaries, the costs analysis and valid service, the court was satisfied it was appropriate to make a Benjamin Order and to authorise the executor to administer the residuary estate and trusts on the footing that Ho Kam Por did not survive the deceased.
