- Court
- Court of Appeal
- Case number
- CAAR1/2006
The Court concluded the original 9‑month sentence was manifestly inadequate given the severity of the attack and catastrophic injuries to the victim. It identified an appropriate starting point of 6 years' imprisonment, reduced by one third for the guilty plea to 4 years, and further reduced to 3 years having regard to time served and exceptional mitigating factors (respondent's character, remorse, family circumstances). The Court quashed the 9‑month sentence and substituted a 3‑year custodial sentence.
