The court upheld the Deputy Judge's decision that the conditions for a mandatory stay under s.20 Cap.609/Model Law Art 8 were satisfied and that an injunction would be self-defeating; the Deputy Judge correctly exercised his discretion in finding the injustice to the defendants from an injunction outweighed any injustice to the plaintiff and that the plaintiff had created the concurrent proceedings; consequently the proposed appeal lacked a reasonable prospect of success and leave to appeal was refused.
