Given the Defendant's substantial success in setting off the Plaintiff's claim against recoveries on the counterclaim, and the Plaintiff's non-admission until the first day of trial, the fair exercise of the court's discretion is to award the Plaintiff costs of their claim only up to the first day of trial, to award the Defendant three fifths of the costs of the counterclaim, and to award the costs of the hearing on 7 May 1996 to the Defendant.
