The application was dismissed because the applicant failed to raise an arguable case that his detention was unlawful: (1) the committal warrant sufficiently identified the offences for extradition purposes whether described as common law or statutory; (2) common law offences alleged were not abolished by statute and thus were known to law; and (3) there was no abuse of process under section 23 justifying refusal to consider the second application. Accordingly no leave to issue a writ of habeas corpus was granted.
