The appeal was dismissed because the new case that the tenancy agreements were partly oral/partly by conduct was not advanced below and therefore barred on appeal (Flywin); the judge correctly excluded the appellant's affidavit material as falling within exclusionary rules and correctly held the written tenancy agreements void for uncertainty as to an ascertainable commencement date and not saved by later execution or by part performance.
