The Court held that whether gambling in Kachin was unlawful is a question of foreign law that required proper proof by expert evidence; PW2 could not be treated as an expert for that purpose and s65DA formalities were not satisfied. Consequently the trial judge's finding that gambling was unlawful in Kachin could not stand and the convictions based on that finding and on the alternative reasonable-grounds conclusion (which the judge did not adequately assess in context of licence/tax/open operation evidence) were unsupportable; appeal allowed and convictions quashed.
