The judge allowed the appeal and set aside the regular default judgment and writ of possession because the defendant demonstrated a real prospect of success that the deceased had communicated a clear intention to transfer his share and had presented a written transfer application to the co-tenant, conduct which could amount to severance in equity under CPO s8(2); in the exercise of discretion the matter should be tried on the merits and procedural deadlines were imposed for pleadings.
