The properly constituted indictment was the one signed on 5 March 1990 by a Senior Assistant Crown Prosecutor who had delegated authority from the Attorney General; the document signed by trial counsel was only an abstract and not an indictment and had no legal effect on the trial; therefore the trial was not a nullity and the application for leave to appeal against conviction was dismissed.
