The appeal succeeded because the magistrate had relied on an incorrect factual premise (apparent belief that the appellant was convicted of both District Court charges) and because, given the relationship of the offences and the circumstances, the 15-month sentence should run concurrently with the District Court sentence for wounding; appellate court therefore varied the sentence accordingly.

Although the judge had grave doubts about the legality of trying separately charged offenders together and acknowledged the principle that want of jurisdiction cannot be cured by consent, he declined to quash the convictions because the only practical remedy would be a retrial; having regard to practice and the appellants' consent he dismissed the appeal and affirmed the convictions.
