Given the pleadings, the negative ponding test result and the pleaded possibility of common‑area causation, the claim was plainly unsuitable for summary judgment and the plaintiff must bear the costs; the Court allowed the appeal, exercised its discretion afresh and ordered the plaintiff to pay the defendant's costs of the Order 14 application and of the appeal forthwith with a certificate for counsel.
