By disclosing an expert report for use at trial the disclosing party waives legal professional privilege in respect of that report and must disclose all antecedent and subsequent reports and communications from the same expert that were considered in forming the opinion, subject only to limited excisions for material which is purely tactical or would be unduly prejudicial; accordingly the Defendant was ordered to disclose all reports and communications from Dr. York Chow within 14 days and the Plaintiff was awarded costs.
