Court exercised its discretion to extend time because the initial non-compliance was a genuine solicitor oversight, the plaintiffs had prosecuted the action with reasonable despatch for part of the period, intervening events (legal aid stay and GAP) materially accounted for delay, the committal application had apparent merit, and there was no real prejudice to the defendant; accordingly time was extended to 14 days from the date of the order for issuing and serving the notice of appointment.
