The court concluded there was a serious question to be tried and on the available evidence the plaintiffs had the stronger claim to the goodwill and marks; damages would be inadequate and the balance of convenience favoured preserving the plaintiffs' goodwill pending trial, particularly given the defendants' surreptitious registration and conduct; accordingly an interlocutory injunction pending trial was granted with limited exceptions for existing contractual obligations and a buy‑back at cost.
