The court held that the appellant established honest concurrent use of CHOW SANG SANG and, on a fresh exercise of discretion under section 13(1)(a) taking account of the extent of use, honesty, historical background and a moderate increase in risk of confusion, the discretion should be exercised in favour of the appellant; the Registrar's refusal was set aside and the application for registration was to be accepted (subject to opposition proceedings).
