Although there was a serious question to be tried that certain named categories of information could be confidential and a duty of confidence may have arisen, the plaintiff failed to demonstrate a real and recent threat of misuse or publication to third parties, failed to particularise misuse for many named companies, and unjustified delay of over five years meant the balance of convenience did not favour injunctive relief; related disputes should be litigated in HCA2065/2019 rather than by satellite proceedings, therefore the summons for interlocutory and interim injunctions was dismissed.
