The court found that Delco's Replies did, in substance, plead fraud in relation to the alleged Scheme but that many of the appellants' requests (framed to elicit the 'basis' of allegations) improperly sought evidential material rather than permissible particulars. The particulars already pleaded were sufficient to give defendants fair notice of the case to be met and to justify permitting Delco to proceed and augment its case after discovery; accordingly the appeals were dismissed and costs awarded to Delco.
