On the factual evidence the judge found that Mr Wu made clear he was contracting in his personal capacity for the staff quarters renovation and that Mr Chan from the Plaintiff accepted that position; the credible testimony and supporting documents (personal cheques, separate plans) established there was no contract between the Plaintiff and the Defendant for the staff quarters, therefore the Plaintiff's claim against the Defendant is dismissed.
