The magistrate's starting point of 18 months reduced to 12 months for a guilty plea was an appropriate and established sentence for making a false representation to an immigration officer; the appellant's personal mitigation did not justify further reduction and therefore the appeal against sentence is dismissed.

Given the very small sum involved, the appellant's immediate admission, guilty plea, long unblemished record and strong mitigation, the custodial sentence should be suspended; the appeal is allowed and the one month immediate imprisonment is suspended for two years, with the consequence that reoffending within that period exposes the appellant to immediate imprisonment of 30 days for this offence.

The sentence should be reduced to allow release today because, although the conduct was serious and deterrence justified immediate custody in general, the specific circumstances (a non‑persisted allegation and apparent stupidity rather than malice, and about one month already served) warranted mitigation of the four month sentence while upholding the need for deterrence in future cases.
