The amendments were disallowed and the consolidated actions dismissed because, as a matter of law, the NPCSC Interpretation declared the correct meaning of the Basic Law from 1 July 1997 so the plaintiffs never had the right of abode and therefore suffered no legally cognisable loss caused by the defendant; the amended pleading was incurable and failed to plead necessary particulars and the mental element for misfeasance.
