The trial judge correctly rejected allegations of police brutality, found the cautioned statements were voluntary, and, together with other prosecution evidence, there was ample evidence to support the conviction; accordingly leave to appeal was dismissed.

The Court held the trial judge did not err: on the voir dire the Crown proved beyond reasonable doubt that the five statements were voluntary, the judge did not shift the burden to the applicant, he properly assessed and rejected the allegations of police brutality (medical evidence was inconclusive and the magistrate complaint was not repeated on oath), and minor discrepancies in police evidence were immaterial; therefore the application for leave to appeal out of time was refused.

The convictions were quashed because the confessional statement, which was the sole basis for conviction, was unreliable and the trial process showed material breaches (including departure from Rule 3, uncertain chronology, untested new allegations due to lack of cross-examination, and gaps in prosecution evidence) such that the convictions were not safe.

The magistrate properly rejected the appellant's affirmations as unproven on the material before him; in these circumstances the plea was not set aside and section 113 does not ordinarily allow appeal after a guilty plea, and the sentences totalling 34 months were appropriate given the gravity of the offences, so the appeals against conviction and sentence are dismissed.

The trial judge properly admitted the statements because his assessment of witness demeanour, the medical evidence, corroborative eyewitness and physical evidence supported voluntariness; even if the point about possible police-inflicted injuries merited fuller consideration, the appellate court concluded it would not have altered the outcome, so the convictions stand.
