On evaluation of all testimonial and medical evidence the court found the police witnesses credible, there was no evidence of intimidation or improper conduct, the defendant's handwriting and confirmation in the notebook demonstrated understanding, medical evidence did not establish incapacity, and therefore PP2 was made voluntarily and is admissible.

Although it could not be excluded that some promises may have been made, the judge was satisfied on credibility, the presence of proper cautions, prior solicitor advice, the exculpatory nature of the account and the defendant's conduct showed his will was not overcome; therefore the interviews and re-enactment statements were voluntary and admissible.

The court, on a rehearing, accepted the trial judge's credibility findings that PW1 was honest and the appellant's accounts were inconsistent and implausible; given the physical evidence (the ATM card affixed to a bank letter) and the circumstances, the only irresistible inferences were that the appellant knew the card did not belong to him and dishonestly appropriated it, and the interview/meeting record was voluntary — therefore the evidence proved theft beyond reasonable doubt and the two‑month sentence was not manifestly excessive.

The application for a certificate under s32(2) was refused because the contested issues raised were applications of established Thongjai principles to the facts of this case rather than new points of law of substantial and general importance; the trial judge had made clear he proceeded on the procedural assumption and did not err as alleged.

On a re‑hearing of the factual evidence the court was satisfied beyond reasonable doubt that PW1 reliably identified the appellant from the fruit stall and CCTV monitoring, that the pork taken came from the supermarket and its chain of custody was intact, that the appellant produced the unpaid pork and made admissions, and that the judge’s questioning did not render the trial unfair; accordingly the conviction is upheld.

The appeal was dismissed because the trial judge's credibility findings were reasonable and supported by the evidence; the oral admission and recorded cautioned statement were properly found voluntary and admissible; taken together with circumstantial evidence (packaging, concealment and placement of goods) the prosecution proved the appellant had dishonest intent to permanently deprive the owner, satisfying the elements of theft beyond reasonable doubt.
