The Deputy Director's power under s.19(1)(b) is exercisable where it appears to him that trigger facts exist but that appearance must be based on reasonable grounds; on the material before him he was reasonably entitled to conclude that the 1st Applicant made false representations that were material and that the children's passports had been unlawfully obtained such that permission to land was vitiated and they had landed unlawfully, therefore the removal orders were lawful and the judicial review failed.
