The appeal was dismissed because the magistrate validly exercised sentencing discretion: the appellant's deliberate overstay while pregnant, together with repeated prior convictions for similar offences and absence of psychiatric disorder on report, removed the basis for a humanitarian discount and justified enhancement to 18 months imprisonment on the primary charge.

Confirmed pregnancy at an advanced stage together with medical evidence of fitness to travel and adequate support in China constituted humanitarian grounds to depart from the usual 15‑month tariff; the court allowed the appeal and reduced the sentences to such time as would permit immediate release for repatriation.

Where exceptional circumstances exist that were not and could not reasonably have been known at the time of sentence — here pregnancy leading to birth in custody — the court exercising powers under Magistrates Ordinance s119(1)(d) may allow leave to appeal out of time, treat the application as an appeal, set aside the sentences and order release; ordinary sentencing policy remains that economic hardship alone is insufficient mitigation but exceptional personal circumstances may justify clemency.
