The court found the Applicant made diligent and timely enquiries from 2021 onwards and only discovered documents linking Noble House to the works on 12 January 2024; the identity of the principal contractor was concealed or not forthcoming from other parties and Noble House did not contest or explain the documents; on these facts the Applicant demonstrated a reasonable excuse under s14(4) ECO and the joinder of Noble House as 4th Respondent was necessary in the interests of justice, so the application was allowed.

Even if the starting point were 'no order as to costs' when the Board is joined, the court will exercise its discretion to order R2 to pay the Board's costs incurred since joinder because R2's persistent dishonest evidence, resistance to joinder and conduct at trial caused additional time and expense and justify departure from the starting point.
