Although the trial judge omitted to state expressly that two uncertain voice-identification witnesses could not be used to support other identification evidence (a material misdirection under Turnbull), the cumulative direct and circumstantial evidence (victim and wife identification, an oral admission, phone possession and call records, keys to the truck and presence at scene) was overwhelming; applying s.83(1) Criminal Procedure Ordinance proviso the Court dismissed the appeal and affirmed the convictions because no miscarriage of justice occurred, and the acquittal of a co-defendant did no…
