The defendant's claim to an equitable purchaser's lien fails because the deposit was never paid to the plaintiffs (the cheque remained unpresented with the plaintiffs' solicitors as stakeholder) and therefore no equitable lien arose; accordingly the registration of the 2nd PSPA was ordered to be vacated (order nisi) and costs were awarded to the plaintiffs.
