The Defendant established a beneficial interest by substantial financial contributions and consistent conduct; the Plaintiffs had constructive notice because they or their agents visited the Property, knew or ought to have known of the Defendant's occupation and failed to make inquiries that a prudent purchaser would have made; accordingly the Plaintiffs could not assert the protection of purchaser for value without notice and their claims were dismissed.
