On the balance of probabilities the judge found the parties entered a partnership for the TST project (supported by parties' conduct, urgent attendance at quote meeting and the partnership account), therefore the applicant was not an employee of the respondent for that project and the claim under the Employees Compensation Ordinance was dismissed.
