Registration and the statutory land-registration regime govern devolution and the existence of sellable undivided shares; Chinese customary family-property doctrine was not part of Hong Kong law for these purposes, so the 1st and 2nd defendants validly disposed of their undivided fourth shares and the lease is not invalid by reference to customary law; on the facts there was no actionable exclusion/trespass by the defendants; partition of the Lot was appropriate and should be ordered with allocation and possible equalization money.
