The Registrar was entitled to refuse registration because, even considered as a whole, the prominent element 'Mild' would give the public the impression of reduced severity or harm, thereby being deceptive; accordingly the applicant's appeal is dismissed.

The counterclaim is a separate action required by rules to be added to the defence for administrative convenience only; because it was filed for the first time it does not 'relate back' to the date of the defence, so the Registrar validly exercised his discretion to grant leave to add the counterclaim.

The Registrar did not misapply her discretion in staying execution because the existence of a bona fide defence required adjudication and there was a real risk that payment to the foreign plaintiff would frustrate recovery; therefore the appeal against the stay was dismissed.
