Because the defendants failed to plead or appear, the court treated the pleaded facts as admitted; those pleaded facts sufficiently established plaintiff's goodwill, defendants' confusingly similar names constituting a representation likely to cause public confusion, and the likelihood of damage to plaintiff; therefore the court exercised its discretion under O.19 r.7 to grant injunctive relief and costs in terms of the plaintiff's summonses.
