The 1st Defendant, entrusted as the Plaintiff's agent, abused that trust and by dishonest representation induced the Plaintiff to transfer her half interest; equitable principles require setting aside the induced transactions, terminating the agency and treating the 2nd Defendant as nominee of the 1st Defendant; consequently the impugned agreements and assignments are set aside and costs awarded against both defendants.
