Plaintiff had no locus standi because the Deed was entered into by Gilbert Leung as principal in his personal capacity; no credible evidence established an Oral Agreement; performance of the Deed would necessarily involve misrepresentations and breach the Grant's restriction on alienation under the Small House Policy so the Deed is unlawful and unenforceable on public policy grounds; Plaintiff failed to prove it bore the expenditure so quantum meruit/unjust enrichment fails for lack of 'at the Plaintiff's expense' and insufficient evidence of quantum.
