The magistrate lacked jurisdiction under the Costs in Criminal Cases Ordinance (Cap 492) to award costs of a review instituted by the prosecution; s3(1)(d) and s3(1)(c) do not empower a costs award to the defence on dismissal of a prosecution-initiated review or on confirmation of a prior acquittal, and the magistrate's costs order was therefore beyond power and must be set aside.
