The magistrate was entitled to accept the prosecution witnesses PW1 and PW2 as truthful and reject the appellant's account; the procedural irregularities identified did not cause prejudice; on the evidence as found credible the conviction for theft was supported beyond reasonable doubt and the appeal must be dismissed.
