Clause 28 of the signed sale contract, being an entire agreement/no‑reliance clause, barred reliance on the alleged pre‑contractual representations, and the purchaser by its subsequent conduct (postponement, advertising and taking possession) elected to affirm the contract and therefore lost the right to rescind; consequently the claims were bound to fail and the strike out was proper.
