The Coroner determined that participation by next of kin of 7 of the 39 deceased is permitted, that death investigation reports and witness statements have been provided to properly interested persons, and that further requests for information and outstanding matters will be addressed at a scheduled third pre-inquest review; the full inquest is fixed for 6 May 2025 for 60 days.

The Coroner exercised case management authority to permit participation by the next of kin of seven deceased, ordered disclosure of the compiled death investigation reports to properly interested persons, and fixed the inquest commencement date (6 May 2025) with 60 days reserved and a further pre-inquest review (14 January 2025) to resolve outstanding disclosure and participation matters.

The judge's date-fixing was a proper exercise of case-management power; the appellant did not provide sufficient reasons or particulars nor demonstrate a relevant connection to HCAL 950/2017 or any bias; therefore the adjournment application was dismissed and the appeal proceeds on 1 June 2018.

The applications were dismissed because hearing the interlocutory appeal immediately after the liability appeal would distract from the main appeal and serve no purpose, and there were no exceptional circumstances to justify expedition given ordinary listing constraints and that delay was not unreasonable in a heavy case.
