The appeal was dismissed because the magistrate correctly found that the appellant applied force and that, in the light of medical evidence (two fractured ribs) and the appellant's superior strength, he had grossly exceeded any reasonable force in preventing the victim reaching D1; the nondisclosure of defence witness statements was irregular but harmless and did not affect the outcome, so there was no basis for appellate interference.
