The appeal was dismissed; however, because the Appellant succeeded on one legal issue (mens rea) and because the Respondent's conduct in opposing the Mandamus application was unreasonable, the Court exercised its discretion under s120 to award the Respondent only half of the costs of the appeal (excluding costs of the Mandamus application) and awarded the Appellant the costs of the Mandamus application, taxed if not agreed; a certificate for two counsel was refused as the case was not sufficiently complex.
