The trial judge properly assessed credibility and found the prosecution witnesses reliable; the appellant's account was implausible; the proffered fresh evidence was unrelated and would not have affected the verdict; therefore the conviction is affirmed.

The Court dismissed the application to treat the Notice of Abandonment as a nullity because the applicant failed to show the abandonment was not a deliberate and informed decision; moreover, even on the merits the conviction was supported by overwhelming evidence so it was neither unsafe nor unsatisfactory, and the conviction and sentence were therefore affirmed.

Magistrate's interventions were a proper exercise of the duty to control the conduct and pace of the trial, did not amount to assuming the role of prosecutor nor demonstrate impartiality failure, and did not cause prejudice to the appellant; therefore convictions on Charges 1 and 3 and the sentence on Charge 2 are to be upheld.
