The Court dismissed the application to treat the Notice of Abandonment as a nullity because the applicant failed to show the abandonment was not a deliberate and informed decision; moreover, even on the merits the conviction was supported by overwhelming evidence so it was neither unsafe nor unsatisfactory, and the conviction and sentence were therefore affirmed.

The trial judge did not misapply his sentencing discretion in reducing the sentence from 7 to 6 years; the plea of guilty did not warrant a larger discount on the facts; therefore leave to appeal is refused.

The trial judge, having seen the witnesses, accepted the police evidence and found the confessions voluntary; those credibility findings were not shown on appeal to be unsafe or perverse, therefore the confessions were admissible and the conviction was upheld.
