Because the accomplice witness expressly admitted hope of a sentence reduction and the judge repeatedly warned the jury to view his evidence with great caution, no misdirection arose under Ngie; furthermore the judge correctly and appropriately directed the jury on circumstantial evidence and inferences from undisputed objective facts; accordingly the application for leave to appeal was refused and the appeal dismissed.

The Court held that the judge did not err in awarding a 40% discount: the appropriate discount for assistance without testifying is fact-sensitive and normally 40%–45%; on these facts Chim's arrest and plea were not attributable to the applicant and the prosecution had a strong case without him, so 40% was within the permissible range; the judge's stray remark about 50% being reserved for 'super-grass' did not affect the outcome.

The Court held that, on the facts, the 50% discount for guilty pleas and assistance was insufficient given the substantial assistance which prevented or facilitated arrest for much more serious crimes; the appropriate remedy was to reduce the two 3-year terms to 2 years and make all terms concurrent so the aggregate sentence became two years imprisonment, and the appeal was allowed.
