The magistrate's starting point of 36 weeks for an overstay of approximately 6 years 4.5 months was not manifestly excessive; a one‑third reduction for early plea to 24 weeks was appropriate; prior detention in 2011 was unrelated to this charge and therefore not creditable; consequently there is no basis to disturb the sentence and the appeal is dismissed.

The Court held that the sentencing judge properly applied sentencing principles: the burglary sentence (2 years) and the 18 months for remaining without authority were appropriate, and the 18 months was rightly ordered to run consecutively because the applicant was a repeated unlawful entrant; there was no basis for interfering with the sentences.

The Court held that the magistrate did not err in principle in treating the offences as warranting a stringent sentence by analogy with illegal immigration cases; the total sentence of 14 months was not manifestly excessive and consecutive sentences on theft and forgery were not improper, therefore the appeal was dismissed.

The trial judge erred in principle by accepting an unproven high repayment figure and by suspending sentences where proven restitution was insufficient and breach of trust serious; immediate custodial sentences were required and, given separate offences, one year on counts 1 and 2 concurrent and one year on count 3 consecutive (total two years) was appropriate; the Court of Appeal substituted those sentences under s.81A.
