The Court held that the magistrate did not err in principle in treating the offences as warranting a stringent sentence by analogy with illegal immigration cases; the total sentence of 14 months was not manifestly excessive and consecutive sentences on theft and forgery were not improper, therefore the appeal was dismissed.

Knowing provision of false information and bogus documentation to police with the intent of securing cancellation of a fixed penalty ticket constitutes an offence under s.63 of the Police Force Ordinance even if the underlying true fact would have provided a lawful defence; proof of one false representation is sufficient to sustain conviction where that falsehood was intended to defeat the ends of justice.

Convictions were supported by the evidence and therefore upheld; however the sentences were excessive and inappropriate in principle given prior punishment and the minimal culpability of two appellants, so the court quashed the imprisonment terms and substituted modest fines.
