Because the factual matrix (investigator purchases, quotations and chops, published notices, overlapping registered addresses, and contested familial and corporate relationships) showed sufficient dispute on identity and relationships, it was not plain and obvious that the wrong defendant had been sued; therefore the proper course was to adjourn the summons to trial rather than dismiss and to order costs in the cause.
