The court granted leave to appeal to the Incorporated Owners only on the narrow question of their authority to close the basement carpark for repairs, refused leave on the ground that the Incorporated Owners could withhold a smart card pending payment because there was no provision in the DMC, Cap 344 or evidence to support such entitlement, held that installation of security measures and implementation of registration/smart card systems were within the management powers, and declined to interfere with the deputy district judge's factual findings and awards of nominal damages.
