The High Court, on re‑hearing, accepted the magistrate’s evaluation of witness credibility and concluded the prosecution proved beyond reasonable doubt that the appellant smoked in a prohibited area and refused to provide particulars; there was no basis to overturn the magistrate’s findings given his advantage in assessing witnesses and the absence of compelling contradictory evidence.

The court upheld the conviction and set aside the fine of $2,000 under s119(1)(e) because the appellant is without means and is serving a substantial custodial sentence for drug offences, making the imposition of the fine impractical and any default imprisonment likely to be concurrent, so the fine would serve no proper purpose.
