The respondent is entitled to costs of its application for security for costs and those costs are summarily assessed at $46,000.

The court found the 1st Appointment was short (approximately 30 minutes), involved no complicated issues, and much preparation could be reused at the adjourned hearing; therefore the petitioner’s claim was excessive. The judge allowed 2 hours for GC ($3,460), 30 minutes for DH ($1,930), 50% of the counsel brief fee assessed at $8,000, and copying $50, disallowed item E2 for lack of necessary details, resulting in a total summarily assessed costs award of $13,440 payable by the respondent to the petitioner pursuant to paragraphs (2) and (3) of the costs order dated 10 July 2019.

The Registrar refused the solicitors' application to increase charge-out rates, accepting the Law Society scale as the primary reference subject to market evidence, applied the seven factors globally, and fixed rates at HK$4,200 for Mr. Kemp (senior partner) and HK$2,100 for Mr. Stranger (associate/paralegal period), thereby dismissing the review of the charge-out rates and reserving costs of the review pending decisions on other items.
